Is there a standard fee which is charged? There is no "standard" fee. Fees are based on a) budget of film; b) music budget of film; c) number of licensed songs being used; d) popularity of song; e) use of song in the film (background vocal/visual vocal, visual source). When do I have to pay for my license? Prior to the first public exhibition of the film. What rights do I need in order to use a song in a film? Synchronization rights and master rights. Synchronization rights allow you to use the words and music of the song (contact publisher) and master rights allow you to use the recording (contact owner/record label of the particular version you wish to use.) The song (words and music) can also be re-recorded for your film as long as the song has been previously recorded and released, and no substantial change in the music or lyrics is being made without permission from the publisher. How long are sync licenses good for? In perpetuity on theatrical releases; negotiable on television and video projects. Do I need permission to include a song in a film to show at a film festival? Yes. Fees are based on budgets, uses, etc. and term (duration of license) up to 1 year; territory; and frequency of exhibition. |
